Foodboss Town User Agreement and Access Form

Agreement

This User Agreement (“Agreement”) governs the use of Foodboss Town, an online nutrition game platform created and owned by the Foodbank of Santa Barbara County (“FBSBC”). By accessing or using Foodboss Town, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. 

 

1. Program Description

Foodboss Town is an online nutrition game created by the Foodbank of Santa Barbara County (“FBSBC”) to complement our Foodboss curriculum and to engage students in foundational nutrition education. This online game platform has been created by a team of qualified professionals and community experts, including a Registered Dietitian Nutritionist and Doctor of Nutritional Biology, to provide experiential learning focused on nutrition, health empowerment, enjoyment and cultural inclusivity. 

 

2. Terms of Use

Access to Foodboss Town is provided solely to the organization that has completed formal registration and/or submitted a donation. This access is:

  1. Access is intended solely for the organization’s internal use: We define “internal use” as use limited to the individuals or communities directly served by the registered organization or group. Access should match the intended use and anticipated number of users outlined during registration.

    1. For Foodbanks or nonprofits, access may be shared with the specific population served under the registered program (e.g., nutrition education participants), but should not be extended to unrelated departments or external partners.

    2. We ask that registrants share an estimate of the number of expected users during sign-up to help us align access appropriately. If usage consistently exceeds 30 users, we will request user-level feedback through a short survey to better understand engagement and improve the tool.

  2. Suggested annual donation: While access to Foodboss Town is provided free of charge, the Foodbank appreciates voluntary donations to support ongoing development and outreach efforts. There is no obligation to donate to access or use the platform.

    1. Suggested donation tiers are based on the organization’s size and operating budget.

    2. FBSBC community partners, local organizations, and Title I Schools nationwide are exempt from fees.

  3. Contingent on feedback completion: You commit to complete a feedback survey to help improve the various aspects of Foodboss Town. If usage consistently exceeds 30 users, we will request user-level feedback through a short survey to better understand engagement and improve the tool.

  4. Non-transferable: You may not share access credentials, links, or materials with parties outside your registered entity.

  5. Non-commercial: You may not sell, sublicense, or commercially exploit any part of Foodboss Town.

Any attempt to share, duplicate, or disseminate access outside of the registered organization without written consent or an agreement from FBSBC is strictly prohibited.

 

3. Liability and Insurance

FBSBC shall not be liable for any damages or claims arising out of or related to the use of Foodboss Town, including any technical issues, data loss, or misuse

 

4. Intellectual Property

All content within Foodboss Town, including, but not limited to graphics, audio, curriculum, and any additional supporting materials, is the intellectual property of FBSBC. No portion of the game platform may be replicated, distributed, modified, or publicly displayed without prior written permission and agreement. 

 

5. Educational Disclaimer 

Foodboss Town is an educational resource and is not intended to replace professional medical or dietary advice. While the online game platform is developed by credentialed professionals, users are advised to consult qualified healthcare providers for individual health needs. 

 

6. User Agreement Updates

FBSBC may update these user terms from time to time. Updated user terms will be emailed directly to the user. Continued use of Foodboss Town following notice of changes constitutes your acceptance of the revised terms. 

 

7. Termination of Agreement

FBSBC reserves the right to suspend or terminate access at its sole discretion if these terms are violated or if unauthorized sharing is detected.
